Obong Bassey Albert Nyong Emerges Authentic And Duly Elected Village Head

–as Court sacks Former University Registrar as Village Head, restrains him from parading himself as Village Head

Obong Bassey Albert Nyong has emerged as the authentic and duly elected Village Head of Mbiaya Uruan in Uruan Local Government Area, Akwa Ibom State. Consequently, an Akwa Ibom State High Court in Uyo has sack Obong Peter Jerome Effiong who had illegally held sway for seven years as the village head of Mbiaya Uruan.

Obong P.J. Effiong was the former registrar of the University of Uyo, Akwa Ibom State before usurping and power as Village Head of Mbiaya Uruan.

In a judgement delivered by Hon Justice Charles U. Ikpe in suit No. HU/298/2017 dated 25th day of November, 2022 between Obong Bassey Albert Nyong (Plaintiff) & Ors. v. Obong Peter Jerome Effiong (Defendant) & Ors.

The Court declared, “that the 1st Plaintiff Obong Bassey Albert Nyong not suffering from any traditional or legal disability, suspension or disqualification of any kind is the authentic Village Head elect of Mbiaya Uruan, Uruan Local government area of Akwa Ibom State having been duly selected by four(4) out of the six(6) Ekpuk heads of Mbiaya Uruan as against two(2) votes polled by the 1st defendant Otuekong Peter Jerome Effiong in the contest held on the 21st January 2016 and acknowledged in the adjudication by the 2nd, 3rd and 4th defendant

“Accordingly the 1st Plaintiff is entitled to be recommended by the 2nd defendant (Uruan Traditional Rulers council) and shall be so recommended to the 3rd (Commissioner for Local Government and Chieftaincy Affairs) and 4th defendant (Executive Governor of Akwa Ibom State) for the issuance of Certificate of Recognition as the Village Head of Mbiaya Uruan forthwith.

The Court averred, “that the recommendation of the 1st defendant by the 2nd defendant to the 3rd and 4th defendant for the issuance of Certificate of Recognition as Village Head of Mbiaya Uruan was improper, wrong and unlawful the said 1st defendant not having been duly selected by proper and authentic Ekpuk Heads or any person whatsoever recognized by law and accordingly all such recommendation or process or part of the process leading to the issuance of Certificate of Recognition to the 1st defendant is hereby declared null and void and of no effect”.

“That the Certificate of Recognition dated 31st December, 2017 issued by the 4th defendant to the 1st defendant (Exhibit 13) not being properly and rightly done is hereby nullified and the 4th defendant is here by Ordered to withdraw same immediately.”

The Court further restrained Obong Peter Jerome Effiong forthwith from parading himself as Village Head of Mbiaya Uruan saying “That the 1st defendant who is not the Village Head of Mbiaya Uruan by this judgement is here by restrained forthwith from parading himself or using the nullified Certificate for any purpose or representing himself in any way to any person or acting in the manner as the Village Head of Mbiaya Uruan and accordingly shall return all paraphernalia of the office to the appropriate quarters in Mbiaya Uruan “

Accordingly, the court ordered “that the 2nd defendant working in conjunction with the 3rd and 4th defendant are hereby ordered to put appropriate machinery in motion and do all such things as would enable and ensure the speedy recommendation, recognition and issuance of Certificate of Recognition to the 1st Plaintiff Obong Bassey Albert Nyong as the Village Head of Mbiaya Uruan Village, Akwa Ibom State”.

“That the cost of N40,000.00 is awarded to the Plaintiff for the success of their suit and payable by the 1st – 4th defendants accordingly.
